The only higher appeal [than the Films Board of Review] is that direct to the Minister (the Attorney-General of Australia) —and he may intervene under Regulation 40 of the Customs (Cinematograph Films) Regulations.

Since January 1971, there have been four [PERCY (1971), THE DEVILS (1971), SKYJACKED (1972), and LANGUAGE OF LOVE (1969)] Ministerial interventions under this regulation:

(a) PERCY June 16, 1971: The Minister (Mr D.L. Chipp) directs the Chief Film Censor to wthdraw the certificate of registration dated May 25, 1971, adding that he would be prepared to agree to film’s registration after introduction of the “R” certificate.

The R-rating was introduced in November 1971. PERFORMANCE was one of a number of films that were eventually resubmitted and passed uncut with the new rating.

In June 1973, a 2970.30-meter (108:16) print was passed with an R-rating under 'Festival conditions'.

This was followed in September 1973 by a 2865.60-meter (104:27) print that was passed with an R-rating. Warner Bros released it theatrically.

Here is David Stratton's overview of the Australian censorship history of PERFORMANCE. He states that the distributor tried again once the R-rating was introduced. However, the submission he is speaking of took place in July 1971, while the R-rating did not come into effect until November of that year.

When a print found its way to Australia in 1971 it was promptly banned. The distributor made cuts, but the “reconstructed” version was banned too. With the introduction of the R certificate late in 1971, the distributor tried again. The film was banned again and the ban was upheld by the Board of Review.

The film was exported, and there the matter rested until it was re-imported by the Sydney and Melbourne Film Festivals for a special season of "lost" films presented as part of the 1973 Festivals. Following these screenings, the film was finally registered R without cuts and could be publicly screened in Australia, five years after it was made.
