REASONS FOR THE DECISION:

In the Board's unanimous view this film warrants an RC, "Refused Classification", in accordance with section 1 (a) of the Films Table of the National Classification Code and the Guidelines for the Classification of Films and Videotapes as it "deals with matters of sex in such a way that they offend against the standards of morality, decency and propriety generally accepted by reasonable adults to the extent that they should not be classified".

In arriving at the decision the Board considered the criteria set out in the National Classification Code and the guidelines for the Classification of Films and Videotapes, Amendment No.2, April 1999. The Board took into account the matters contained in Section II of the Classification (Publications, Films and Computer games) Act 1995 (the Classification Act):

- the standards of morality, decency and propriety generally accepted by reasonable adults; and

- the literary, artistic or educational merit of the film; and

- the general character of the film; and

- the persons or class of persons to or amongst whom it is published or is intended or likely to be published.

In the Board's view this film has not been appropriately modified in terms of the amended X classification guidelines, effective 18 September 2000, to be accommodated within the X classification. The amended X classification guidelines state that it does not permit any depictions of fetishes such as body piercing, application of substances such as candle wax, 'golden showers', bondage, spanking or fisting.

At 52 mins a naked woman is shown to lie below a male who begins to urinate on her. Although the actual urination is pixellated the scene is set up in such a way that there is no doubt that a golden shower is occurring, that is, urination onto the woman's face and body. Other scenes of urination in this film have been sufficiently modified and not set up such as this scene in which there is no doubt as to what is occurring and can accommodated within an X classification.

REASONS FOR THE DECISION:

When making this classification decision the Classification Board (the Board) followed the procedure set out in the Classification (Publications, Films and Computer Games) Act 1995 (the Act).

The Board also applied the National Classification Code and the Classification Guidelines, while taking into account the matters set out in Section 11 of the Act. The National Classification Code states that the X category for films contains explicit depictions of sexual activity between consenting adults. However in accordance with the National Classification Guidelines no depiction of fetishes such as 'golden showers' is allowed.

In the Board's majority opinion this film warrants RC (Refused Classification) in accordance with Part I of the Film Table of the National Classification Code, as it contains a depiction of 'golden showers' which although pixelated is not sufficiently obscured to be accommodated within the X classification.

At approximately 69 minutes a man is seen to be standing near two women who are kneeling on the floor with their mouths open. The man is seen to commence urinating, the woman's face and upper body is then pixelated. In one frame the depiction includes; the man urinating; the woman's hair seen above the pixelation; and the woman's upper arm touching the man's thigh. At another point fluid is seen on one of the woman's lower abdomen, the camera then scans up her body as the image is pixelated. the man then comes into view and is seen to be urinating. In the Board's majority opinion this act can only represent the fetish 'golden showers' as it is obvious that the urine must be going onto the woman's body and the pixelation is not sufficient to create the doubt that the depiction of the fetish may have been simulated.

In the minority Board opinion this depiction is sufficiently pixelated to allow the possibility that the urine is not going onto the woman's body and that the fluid on the woman's body may not be urine.

 

 

Golden Showers and the X18+ rating

In September 2000, the classification guidelines were revised and golden showers banned as an offensive fetish. The adult industry attempted to get around this by pixelating the offending images. In this case, the amount of pixelation was found to be to insufficient. This was also true for another German feature called CAR WASH.

In early 2001, AXIS applied to have CODENAME ECSTASY, and several other titles reviewed. Despite the applications being outside the normal time provision, it was hoped that the Review Board would agree to examine them.

 

AXIS explained the reason for the CAR WASH and CODENAME ECSTASY delay as:

These titles were refused on the grounds that the company when pixelating scenes said to be a fetish like 'golden showers' were insufficient to obscure the intent of the participant's activities. The company categorically refutes the refusal for classification on the grounds that more than adequate compliance to the requirements of the new guidelines had been taken.

Both these titles were delayed during lengthy consultations with the internal AXIS review panel and research into other instances of similar cases, along with the aforementioned instances of receiving other titles while reviewing the appeal that needed inclusion on similar grounds.

 

The Classification Review Board was unconvinced, and refused to allow a review. Their reasons were:

The Classification Review Board is not persuaded that it is appropriate in all the circumstances to exercise its discretion pursuant to section 43(2)(b) of the Classifications (Publications, Films and Computer Games) Act 1995 to extend time to apply for review in relation to the applications made on behalf of your company

 

The AXIS Group have never submitted a revised version.

In her book SNATCHED: SEX AND CENSORSHIP IN AUSTRALIA, Helen Vnuk's wrote that this type of self-imposed censorship has since been dropped by the adult industry following complaints from consumers. Instead, this type of film is no longer picked up for Australian distribution.

Adult Film Classification

Reverend the Hon. FRED NILE [5.25 p.m.]: The industry involved in the illegal sale of unclassified and refused-classification movies and the sale of X-rated videos or movies in videotape or DVD format operates mainly in the Australian Capital Territory. X-rated videos are available for sale from pornographic shops in the Australian Capital Territory, and sadly also by mail order to residents of New South Wales. That material is financed and produced mainly in the United States of America by organised crime, including the Mafia. Some of that material has input from Germany and other countries. A great amount of the material includes the abuse of girls, particularly Asian girls.

I have received copies of emails sent between Robbie Swan and his partner Fiona Patten of the Eros Foundation, who are actively involved in the importation and sale of prohibited goods, which they bring into Australia and seek to put through Australia's classification system. The movies, on DVD or videotape, have been refused classification due to violence and under-age actors. In some cases they use actors of legal age who purport to be children and are intended to depict children. The emails indicate that Brett and Camilla Allen are also involved in the sale of prohibited imports.

An individual named Royston applied for classification of certain offensive material in the correct expectation that it would be refused. Patten's comment of 18 June 2007 that Royston does not distribute Crush/Dark Angels 2—Bloodline in film or DVD gives the game away that she deals with the distributor. The majority of the Eros Association members sell unclassified material, which is illegal. Penalties are much higher for selling refused-classification material and possession of refused classification material can lead to 12 months imprisonment. Approximately 500 adult shops sell unclassified and -classification material. X-rated material is legal for sale from the Australian Capital Territory, but refused-classification material is not.

The Eros Foundation has campaigned for legalisation of X-rated material in New South Wales, and has often attacked me in the media and in its publications. Members of the Eros Foundation also sell unclassified material. During the recent State election, the Eros Foundation produced a radio advertisement calling on listeners to vote for the Greens and against me.

The Greens made no complaint about receiving support from that pornographic company. I am advised that Customs does little to prevent the importation of unclassified material. All unclassified material should be held in bond until it is classified and it should be destroyed if classification is refused. When Paul Green, the Christian Democratic Party candidate for the Senate, is elected at the next Federal election, he will introduce a private member's bill that will make appropriate amendments to the Customs Act 1901. The emails that I have received also suggest an unhealthy and close relationship between these pornographers and Tony Brown, a former acting executive director to the Commissioner for Fair Trading in the Australian Capital Territory.

There was a similar unhealthy relationship involving Des Clark, former director of the Office of Film and Literature Classification. Those relationships are a cause for great concern. When Des Clark was leaving his role, Robbie Swan of the Eros Foundation said, "I will send him a nice original erotic Indian miniature painting as a thank you for what could be considered as a good term as Director." I am very concerned about these close relationships between pornographers and people in charge of film classification, or people working for the Commissioner for Fair Trading in the Australian Capital Territory. I call on the Federal and State governments to investigate these relationships to ensure that public servants are not breaking the law.

Adult Film Classification

The Hon. AMANDA FAZIO [6.18 p.m.]: Tonight I wish to set the record straight over the classification of adult films in this country. In a recent speech in this place the Reverend the Hon. Fred Nile stated that the illegal industry in unclassified and refused classification adult films "operates mainly from the Australian Capital Territory". That is demonstrably untrue and a slur on the Australian Capital Territory Government's X Licensing Scheme, which only allows federally classified adult films to be sold from licensed adult shops and not the illegal kind referred to. In fact, the former Australian Capital Territory registrar for X films, Mr Tony Brown, is on record stating that there is 99 per cent compliance with the scheme. I am reliably informed that the vast majority of unclassified and refused classification adult films are sold in States, including New South Wales, where sale is not regulated by government, but not in the two Territories where sale is regulated by Government.

So, in fact, the Australian Capital Territory is the only jurisdiction in Australia that has regular government inspections to keep out the kind of material that was alluded to. Reference was made also to Mr Brown being in an unhealthy and close relationship with these pornographers. This slur, on a man with an impeccable history of public service over 20 years, is totally unjustified. It was stated also that material for sale in the Australian Capital Territory was produced by the United States mafia and included the abuse of Asian girls. Again, I am reliably informed that the vast majority of this material coming from the US is produced by large, well-known companies that all adhere to the very strict US 2257 legislation and has been inspected and approved by the Federal Bureau of Investigation.

Reverend the Hon. Fred Nile went on to state that he had been contacted by an individual named Royston, who had supplied him with emails that showed that the two people who run the adult industry's national association—the Eros Association—are actively involved in the importation and sale of prohibited goods, which they bring into Australia and seek to put through Australia's classification system. He stated also that these films were refused classification due to violence and under-age actors. This is a very serious allegation and one I believe to be completely untrue. I support the legalisation of the sale of x-rated material or non-violent erotica in New South Wales.

I believe that if the sale of such material were to be made legal, it would stop the ludicrous situation whereby it is legal to buy such material by mail order, have it posted to New South Wales and view it in New South Wales but it is illegal to go into an adult shop in New South Wales and buy such material and it is illegal, of course, for adult shops to sell such material. I have had contact with representatives of the Eros Association over the years since I was elected to this place. At all times I have found them to be responsible and professional advocates for the adult industry in this country, and to be strongly opposed to the importation or sale of unclassified and refused-classified materials and the pirating of legally available material.

I have been approached by Ms Patten, who absolutely denies the allegations and has told me that she and Mr Swan have only ever applied to classify one film in Australia—the hanging of Saddam Hussein—and that was to demonstrate their concern at violent films being too easily available to the community and to minors. They were trying only to highlight the issue. They have never applied to classify an adult entertainment film and have never been involved in the importation and sale of any adult goods, let alone prohibited adult goods as alleged. The allegation that they would in any way try to import child pornography is a calculated attack designed to cause maximum harm to their reputation and hurt to their personal lives. I believe that allegation should be withdrawn.

Ms Patten has been the leading campaigner in Australia for the international online child pornography reporting organisation, the Association of Sites Advocating Child Protection. The assertion that she would be trying to bring child pornography into the country is simply not sustainable. It was stated also that Ms Patten and Mr Swan had an unhealthy relationship with the former Director of the Office of Film and Literature Classification, Des Clark, and that their relationship could have been illegal in some way. It appears that this allegation was based on emails forwarded to him, which outlined discussing an end-of-term gift for Mr Clark. There is nothing sinister in industry groups giving small gifts to departing heads of regulatory bodies. The notion that an erotic miniature could be said to form the basis of an unethical and illegal relationship is an extreme point of view that is not sustained by normal business practices.

I strongly suggest that Reverend the Hon. Fred Nile take a close look at the motives of his informant, Mr Thomas A. Royston. For a start, I find it surprising that he would take the advice and direction of a man who runs a number of adult and x-rated businesses in the Australian Capital Territory. Mr Roysten currently is being sued in the Federal Court by a public company over a million-dollar debt. He is being investigated by the Australian Securities and Investments Commission for serious breaches of the Corporations Act and currently is under investigation by a US company for serious copyright breaches. I have looked at one of his websites, which I will not name here, and have seen that he sells drug-use paraphernalia, including ice-pipes, weighing scales, drug-deal bags and cocaine grinders. I noted also that Mr Royston's post office box in Canberra is PO Box 666.

I am concerned that Reverend the Hon. Fred Nile may have been dealing unwittingly with the devil on this issue—a devil who has many axes to grind with legitimate operators in the adult industry—and as a result has unjustifiably sullied the reputations of a number of individuals, businesses and government departments. I suppose the lesson to all of us is that we should look carefully at people who bring these sorts of complaints to us and ask us to raise them in public. We really must be sure of the veracity of the information these informants give us before we raise them in this House.
